TERMS AND CONDITIONS OF USE
EcoMapping® and EMAS Easy™
Page 2 of the EMAS Easy™ manual states that the tool is free to use by organisations as long as it is not for commercial use and that the owner of the intellectual property (ie, Heinz Werner Engel) is acknowledged.
Where the intent is to use the tools for commercial use then users must be trained in the use of the tools and satisfy the criteria that follow.
Note: The term ‘tool’ is used to describe the EcoMapping® and EMAS Easy™ processes.
The tool can be used free of charge by organisations for non-commercial use. This means that they may use the tool, free of charge, for their organisation as long as they do not make a commercial profit.
Simply:
- Organisations can use the tool for their own use
- Organisations can provide consulting services and advise as long as they do not charge for their services.
Commercial purposes means that the person or organisation is charging for their services. If an organisation or person wishes to use the tool for commercial purposes, then they must comply with the following requirements.
Consultants
Consultants need to be trained in the use of the tool, which means they need to attend a three-day training course and a subsequent refresher course every three years.
The training course is a three-day course conducted by ECAP or an ECAP-approved trainer.
On successful completion of the training course, consultants will be provided with an international registration number and certificate. They can then consult anywhere in the world in the use of the tool.
For active consultants, the name of the consultant and the name of the organisation they work for will be displayed on the ECAP website.
Industry Associations
Industry associations are welcome to use the tool free of charge, for themselves and their members, as long as they do not charge for using the tool or for training.
Industry Associations are also encouraged to ‘add on’ industry specific requirements; for example, ‘requirements for chemical storage’ or industry ‘indicators’.
If the industry association uses the tool and the term EMAS Easy™ or EcoMapping®, then the industry association must:
- Use trained consultants in the delivery of the tool
- Be recognised by ECAP.
Recognition by ECAP involves a review of the use of the tool by the industry association plus a fee for the use of the tool.
Educational Institutions
Educational institutions are welcome to use the tool free of charge, for themselves and their members as long as they do not charge for using the tool or for training.
If an educational institution wishes to train people in the use of either EcoMapping® or EMAS Easy™, then their trainers must have suitable qualifications and experience in the use of the tool.
To train others in the use of EcoMapping®, the training providers must attend a one-day training course conducted by ECAP or an approved trainer, with a refresher course every three years.
To train others in the use of EMAS Easy™, the training provider must satisfy the requirements of ECAP, which involves completing the three-day training course as well as facilitating two companies in different industry sectors to ISO14001 or EMAS using the EMAS Easy™ tool.
The tool cannot be changed or integrated into customer tools without the express permission of ECAP.
Trainers
Individuals seeking to be recognised as an ECAP-endorsed EMAS Easy™ trainer must have:
- Completed the three-day EMAS Easy™ training course
- Attended tri-annual update training (where appropriate)
- Taken at least two companies from two different industry sectors to ISO14001/EMAS
using the EMAS Easy™ model
- Co-facilitated two EMAS Easy™ training sessions with Heinz Werner Engel or an ECAP registered training provider.
